Benjamin Franklin stated, "Those who would give up essential Liberty, to purchase a little temporary Safety, deserve neither Liberty or Safety." Yet under the guise of "National Emergencies" the people acquiesce or voluntarily give up their liberties in order to be protected. In the definition of de facto government it states "a government deemed unlawful, or deemed wrongful or unjust, which, nevertheless RECEIVES PRESENTLY HABITUAL OBEDIENCE FROM THE BULK OF THE COMMUNITY". One of my favorite case citations that detail such acquiesce and regulation of rights is the Supreme Court case Aptheker v. Secretary of State in which the court states: "Free movement by the citizen is of course as dangerous to a tyrant as free expression of ideas or the right of assembly and it is therefore controlled in most countries in the interest of security. That is why riding boxcars carries extreme penalties in Communist lands. That is why the ticketing of the people and the use of identification papers are routine matters under totalitarian regimes, yet abhorrent in the United States.
